Understanding how a revocable living trust compares to an irrevocable trust helps clarify which planning tools belong in your estate plan and why.

Revocable vs. Irrevocable Trusts

The defining difference is flexibility. A revocable living trust can be amended at any time during your lifetime to reflect new assets, a marriage, a divorce, the birth of children or grandchildren, a change in successor trustee, or any other shift in your circumstances. An irrevocable trust generally cannot be changed once established. In exchange for that loss of flexibility, an irrevocable trust can offer stronger creditor protection and potential tax advantages that a revocable trust doesn’t provide.

California law does provide limited mechanisms for modifying irrevocable trusts in certain situations, including trust decanting and judicial modification, but these are not simple processes.
